IDT STUDY CIRCLE MEETING ON SC DECISION IN CASE OF DILIP KUMAR & ORS AND ISSUES FROM EXEMPTION NOTIFICATION

Recently, the Constitutional Bench (five judge bench) of the supreme court in case of Dilip Kumar and Ors (the taxpayer) has overruled the ratio laid down by the three judge judgement in case of Sun Export Corporation.
We have witnessed many changes/ amendments in the GST law since the beginning of the GST Law especially with respect to rate notifications, exemption notifications, etc. Till date, there have been grey areas pertaining to claiming several exemptions under GST. It is extremely important to thoroughly analyse the exemptions under GST and thereafter apply the same.
With a view to have in depth analysis on such exemptions, the Indirect Tax Committee of the Chamber of Tax Consultants have organized study circle meeting. We have invited Advocate V. Raghuraman to explain implications of this decision on manner of interpreting exemption notifications.. The details of the meeting is as under:
