The Finance Bill (No. 2), 2019 was tabled in the Parliament on 5th July, 2019. The first policy document of NDA 2.0 lead by Prime Minister Narendra Modi also the new finance minister. The Finance Bill runs to 113 pages with more than 200 amendments being proposed to various tax laws and also penal laws like PMLA, Benami Law and Black Money Act etc. The changes in direct taxes laws range in wide areas like:
• Recognition of Adhaar in lieu of PAN,
• Introducing TDS on withdrawal of cash and payment by Individual/HUF
• Introducing mandatory filing of return of income for certain Individuals even if they do not have taxable income
• Incentives – for purchase of affordable house, electric vehicle, NPS
• Benefits to Startups, NBFC, IFSC, AIF II, Offshore funds
• Expanding the scope of gift tax (Section 56(2)(x)), buy back tax
The amendments proposed by the Finance Bill will have far reaching impact and it is a must for any tax professional to study the amendments and its impact in a thorough manner. The amendments pose newer challenges for a tax professional to learn, unlearn and relearn the provisions of the Income-Tax Act in a detailed manner
