Recently, Hon’ble Andhra Pradesh High Court has dismissed Writ Petition challenging Constitutional validity of Section 16(4) of CGST Act, 2017 insofar as imposition of time limit for claiming Input Tax Credit and has held that Section 16(2) of CGST Act, 2017 has no overriding effect on Section 16(4), in case of Thirumalakonda Plywoods.
